In July 2022, a conversation with a patient got out of hand. The patient filed a complaint. At the beginning of this year, the regional disciplinary tribunal ruled that this complaint was partially well-founded and imposed the cancellation of the BIG registration as a measure until the decision had become final. The GP was then no longer allowed to perform his duties with immediate effect.
That remains the case, because the profession of the general practitioner was of no avail. This week, the Central Disciplinary Tribunal rejected the appeal against the decision. In fact, on one part of the complaint, the Central Disciplinary Tribunal ruled that the complainant's appeal succeeded.
The Central Disciplinary Court is also of the opinion that the most severe measure should be imposed on the general practitioner, that of cancellation of the registration in the BIG register.' The Central Disciplinary Tribunal indicates that it 'has no confidence that the GP will not cross a line again in contact with patients in the future. There is a high chance of a recurrence.'
'Insufficient learning capacity'
In February's judgment, account was already taken of the fact that the GP had previously come into contact with disciplinary law because of similar actions. In 2013 he was given a conditional suspension by the disciplinary body, in 2018 he was reprimanded for similar offences. The board stated that the general practitioner 'does not have sufficient learning capacity – and perhaps does not have the will – to permanently adapt his behaviour towards patients to what is considered appropriate and professional.'
In recent years, UT students and staff have repeatedly shared their (negative) experiences with the practice on campus. During a PhD debate in 2023 about workload, several attendees also complained about general practice. Rector Tom Veldkamp lashed out at the time: 'We completely disagree with everything this GP does'. Veldkamp openly distanced himself from the practice, but indicated that there was not much he could do, because the UT does not have a formal role in the practice.
